Users of our platform must not engage in any activities that:
a) Violate any applicable laws, regulations, or statutes.
b) Pose excessive financial, reputational, or other risks to GizmoGrind Inc.
c) Promote harmful, offensive, hateful, or deceptive content.
d) Infringe upon the intellectual property rights of third parties.
e) Involve fraudulent or misleading behavior or misrepresentation.
f) List lost, stolen, or blacklisted items.
g) Use profanity when communicating with other users, buyers, or our customer service team.
Only used electronics are allowed to be listed for sale on our platform. Any items that do not fall within this category are not permitted and may result in consequences such as termination or suspension of your access to our platform.
Listing Accuracy and Returns
When listing an item for sale on the GizmoGrind Marketplace, it is the responsibility of the seller to ensure that the item is accurately described and in the condition stated during the listing process. If an item is found to be in a lower condition or not as advertised, the buyer is responsible for return shipping with a valid tracking number. The seller is required to provide a full refund upon receipt of the return. It is important that sellers correctly select the condition that corresponds to their used device to avoid permanent removal from the platform.
Pre-approval Requirements for Listings
All market listings require pre-approval before the listing is live. Our team will:
a) Check for a photo with a provided code visible to verify photo authenticity.
b) Review the user's account for any previous suspicious activity or violations.
c) Verify the IMEI, where applicable, to ensure non-blacklisted phones are listed.
d) Assess the model and condition based on provided photos to ensure they match the seller's claimed model and condition.
We provide various channels for third parties to report potential AUP violations or concerns, such as:
a) A dedicated email address or contact form for reporting problematic content or activity.
b) A separate channel for rights owners to report alleged intellectual property rights concerns.
c) A direct line of communication for law enforcement officials or regulators to engage with our team.
To ensure effective enforcement of our AUP, we implement the following measures:
a) Pre-screening measures for customers before allowing their products/services on our platform.
b) Technological solutions to scan for potentially problematic content, including the use of third-party monitoring tools.
c) Clearly outlining the consequences of non-adherence to the AUP in our terms of service, including warnings, temporary or permanent suspension, and potential legal action.
d) Employing staff dedicated to enforcing the AUP, including pre-screening, continuous monitoring, and addressing third-party reports.
e) Establishing protocols for reporting information to our leadership and notifying law enforcement of any potentially illegal activity on our platform.
Limitation of Liability
a) GizmoGrind Inc. is not responsible for any loss or damage resulting from improper packing or shipping of devices by customers.
b) In our marketplace service, customers assume all risks related to transactions, and GizmoGrind Inc. is not liable for any disputes or issues arising between the buyer and seller.
c) We reserve the right to reject any customer or transaction at our sole discretion without prior notice.
